EroCams Terms of Service (TOS)

> **Important:** EroCams is an adult‑only live‑streaming platform. By accessing the Site you confirm that you are at least **18 years of age** (or the age of majority in your jurisdiction, whichever is higher) and that viewing or broadcasting sexually explicit material is legal in your location.

## 1. Introduction

1.1. These Terms of Service ("**TOS**") constitute a legally binding agreement between you ("**User**", "**you**") and the operator of *www.erocams.com* (the "**Site**"), mobile applications and related services (collectively, the "**Service**"), hereinafter referred to as "**EroCams**", **headquartered in USA and Saint Vincent and the Grenadines** ("**we**", "**our**").  

1.2. By using the Service you agree to comply with this TOS, our **Privacy Policy**, **Cookie Policy**, and any additional rules or guidelines posted on the Service. If you do not agree with any part of these Terms, **do not access or use** the Service.

## 2. Definitions

- **Account** – the personalised section of the Service created after registration.  

- **Performer** – a User who broadcasts, uploads, or otherwise distributes adult content via the Service.  

- **Viewer** – a User who watches streams or accesses Content without broadcasting.  

- **Content** – any text, images, audio‑visual material, livestreams, metadata, or other materials uploaded, displayed, or transmitted through the Service.  

- **Tokens** – virtual credits purchased by Users and used to tip, unlock, or otherwise interact with Performers; Tokens have no monetary value outside the Service.  

- **Prohibited Content** – Content that violates section 7 of this TOS.

## 3. Eligibility & Age Verification

3.1. Access is restricted to adults. You must be **at least 18 years old** *and* have reached the age of majority in your jurisdiction.  

3.2. We reserve the right to require government‑issued photo ID and live selfie verification to confirm your age and identity (KYC).  

3.3. Parents and guardians are solely responsible for installing parental‑control tools to prevent minors from accessing the Service.

## 4. Account Registration & Security

4.1. You must provide accurate, current, and complete information during registration and keep it updated.  

4.2. You are responsible for maintaining the confidentiality of login credentials and for all activities that occur under your Account.  

4.3. Sharing or selling Accounts is strictly prohibited; violation may result in immediate termination.

## 5. User Conduct & Community Guidelines

5.1. You agree **not** to:

- harass, threaten, or bully Performers or other Users;  

- spam chat with repetitive messages or promotional content;  

- request or share personal contact information;  

- encourage illegal activity or self‑harm;  

- impersonate EroCams staff.  

5.2. We may mute, suspend, or ban Users who violate Community Guidelines without prior notice.

## 6. Performer Requirements & Obligations

6.1. Prior to first broadcast, Performers must complete full KYC, age‑verification, and 18 U.S.C. §2257 record‑keeping compliance.  

6.2. All persons appearing in a broadcast must be fully documented and expressly consent to public distribution of their image and likeness.  

6.3. Performers must:

- comply with local laws where the broadcast originates;  

- ensure all sexual acts are consensual, safe, legal, and between adults;  

- refrain from advertising escort or in‑person sexual services.

## 7. Content Standards & Prohibited Content

Content **must not** include, depict, or promote:

- minors (real, cartoon, simulated, or anyone who *appears* under 18);  

- non‑consensual or exploitative acts (rape, trafficking, intoxication, blackmail);  

- bestiality, necrophilia, incest, extreme violence, or bodily harm;  

- hate speech, terrorism, or extremist ideology;  

- revenge porn or doxxing;  

- weapons or illegal drug use.  

EroCams employs automated detection and human moderators; violation can lead to Content removal, account termination, and notification of authorities.

## 8. Intellectual Property & Licences

8.1. Performers retain **all intellectual‑property rights** to their original Content. By broadcasting, you grant EroCams a worldwide, non‑exclusive, royalty‑free licence to host, stream, distribute, and promote your Content for the limited purpose of operating the Service.  

8.2. No User may record, reproduce, redistribute, or commercially exploit any Content without the rightful owner’s written consent.  

8.3. The EroCams name, logo, and software are protected by trademark and copyright laws.

## 9. Virtual Currency (Tokens) & Billing

9.1. Tokens are sold in bundles; prices and applicable taxes are displayed at checkout.  

9.2. All sales of Tokens are **final and non‑refundable** except where required by law.  

9.3. Tokens do not constitute electronic money; they cannot be exchanged for cash by Viewers and are valid only within the Service.

## 10. Performer Earnings & Payouts

10.1. Performers earn a percentage of Tokens received; the current payout rate is displayed in the Performer Dashboard.  

10.2. Minimum payout threshold, supported payment methods, and payout schedule are listed in the Dashboard.  

10.3. We may withhold payouts if fraud, chargebacks, or TOS violations are suspected.

## 11. Chargebacks, Refunds, and Disputes

11.1. In the event of a credit‑card chargeback, EroCams may deduct the disputed amount plus processing fees from the Performer’s balance.  

11.2. Users must first contact EroCams Support (**[email protected]**) to attempt resolution before initiating external dispute procedures.

## 12. Data Protection & Privacy

12.1. EroCams processes personal data in accordance with applicable privacy laws, including the EU **General Data Protection Regulation (GDPR)**, where relevant.

## 13. DMCA & Copyright Policy

13.1. If you believe Content infringes your copyright, submit a takedown notice to **[email protected]** containing the information required by the Digital Millennium Copyright Act (17 U.S.C. §512).  

13.2. We respond to valid notices within 48 hours and may suspend repeat infringers.

## 14. Third‑Party Services

14.1. The Service may include links or integrations to third‑party websites and payment processors. We are **not responsible** for third‑party content or practices.

## 15. Suspension & Termination

15.1. We may suspend or terminate your Account immediately if:

- you breach these Terms or applicable law;  

- we are required by law‑enforcement request;  

- your continued use poses risk to Users or EroCams.  

15.2. Upon termination, any unused Tokens are forfeited; Performer balances may be withheld pending investigation.

## 16. Disclaimers & Limitation of Liability

16.1. The Service is provided **"as is"** and **"as available"** without warranties of any kind.  

16.2. To the maximum extent permitted by law, EroCams will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill.  

16.3. Our total aggregate liability shall not exceed the greater of (a) the amount you paid us in the three months preceding the claim, or (b) €100.

## 17. Indemnification

You agree to indemnify, defend, and hold harmless EroCams and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising out of your breach of this TOS, your Content, or your violation of any law or third‑party rights.

## 18. Governing Law & Dispute Resolution

18.1. This TOS shall be governed by the laws of Saint Vincent and the Grenadines, without regard to conflict‑of‑law principles.  

18.2. **Arbitration.** Any dispute not resolved informally will be finally settled by binding arbitration under the Arbitration Act of Saint Vincent and the Grenadines. Judgment on the award may be entered in any court of competent jurisdiction.  

18.3. **Opt‑Out.** You may opt‑out of arbitration within 30 days of Account creation by emailing **[email protected]**.

## 19. Modifications to the Service and TOS

19.1. We may modify the Service or these Terms at any time for legal, technical, or operational reasons.  

19.2. We will notify Users via the Site or email at least **14 days** prior to changes taking effect. Continued use constitutes acceptance.

## 20. Miscellaneous

- **Severability:** If any provision is unenforceable, the remaining provisions remain in effect.  

- **Waiver:** Failure to enforce any provision is not a waiver of future enforcement.  

- **Force Majeure:** We are not liable for delays caused by events beyond our reasonable control.  

- **Assignment:** You may not assign your rights or obligations under this TOS without our prior written consent.
